Interpretations
- “The Seller” means Martin McGinn & Sons Ltd or its successors, assignees, sub-contractors, and authorised agents acting within the terms of their agency agreement.
- “The Buyer” means any person, firm, company, or authority who places an order or purchases the Goods or Services, including any receiver, administrator, administrative receiver, or judicial administrator.
- “The Goods” means the goods and/or materials supplied or sold by the Seller to the Buyer in accordance with the terms of any individual contract.
- “The Service” means any service provided by the Seller in accordance with the terms of any individual contract.
- “Order” means any order placed for the Goods or the Services.
- “The Contract” means the particular individual contract for the sale or supply of the Goods and/or Services by the Seller to the Buyer.
- “Point of Delivery” refers to the delivery location as agreed within any individual contract.
- Reference to any statute or statutory provision includes a reference to that statute or statutory provision as from time to time amended, extended, or re-enacted.
- Reference to any clause is to a clause of these Conditions of Sale.
- “Conditions” means the terms and conditions of sale set out in this document, together with any amendments from time to time made and notified in writing, and any special additional terms expressly agreed in writing by the Seller.
Terms and Conditions
- These Conditions shall govern the contract to the exclusion of any terms or conditions which the Buyer purports to apply under any purchase order, confirmation of order, specification, or other document. The Buyer waives any right to rely on such terms or conditions.
- No variation to these Conditions or any representation about the Goods shall have effect unless expressly agreed in writing and signed by a duly authorised representative of the Seller.
- The Seller accepts orders via website or telephone but holds no responsibility for any errors or omissions arising from these methods of order placement.
- No order placed by the Buyer shall be deemed accepted by the Seller until an email acknowledgment of the order is issued by the Seller or (if earlier) the Seller delivers the Goods to the Buyer.
- The Buyer must ensure that the details of the order and any applicable specification are complete and accurate.
- All orders will be delivered within 1-5 working days of purchase.
- The Buyer must ensure access to their oil tank is available from the day the order is placed to facilitate delivery.
- The Buyer is responsible for checking before placing an order that their address is within our delivery radius.
- In the event that the delivered amount is less than the amount ordered, a refund for the monetary differencewill be processed within 3-10 days.
- Use of our site is restricted to persons aged 18 and over.
- Martin McGinn & Sons Ltd reserves the right to sub-contract the performance of any order placed.
- Martin McGinn & Sons Ltd reserves the right to amend these Terms and Conditions at any time without prior notice. Such amendments will take effect upon being uploaded to the website, and it is the Buyer’s responsibility to check for the latest version.
By placing an order with Martin McGinn & Sons Ltd, the Buyer agrees to be bound by these Terms and Conditions.
